Mr Juarez, a 46-year-old man whose vision was considerably impaired last year due to diabetes, is suing a casino in Broward County for not taking appropriate action to cater to his disability.
Despite losing his job as an air conditioner repairman and no longer being able to play pool in his free time, Mr Juarez has remained determined to keep playing poker. However, due to the problems with his vision, Mr Juarez is only able to read cards if they are right in front of his face. Due to this problem, he has enlisted a friend to sit behind him and inform him of which other cards are in play at the poker table at the casino.
Unfortunately, Mr Juarez encountered problems when he visited the Capri Casino in Pompano Beach for a game of poker. He was denied a request for an end seat at a table at the casino to make it possible for a fair game where he would neither be disadvantaged nor at an advantage due to his reader seeing other players' cards.
Luckily for Mr Suarez, the Disabilities Act strictly prohibits any kind of discrimination against the disabled. The Capri Casino is now being sued under this legislation for failing to accommodate Mr Juarez's needs. The action has been refuted by Robert Bauroth, an attorney for the casino, who claims that there has been no discrimination at the casino and that Mr Juarez's request was a request for a personal service that went beyond this legislation.
Despite this, the Isle of Capri Casinos Pompano Park is the only of many casinos in South Florida that has refused to accommodate Mr Juarez's needs with regards to playing poker.
The lawsuit seeks injunctive relief. The parties are still awaiting its outcome.
